Federal court blocks Texas voter ID law

WASHINGTON (Reuters) - A federal court on Thursday blocked a Texas law that would require voters to show photo identification before casting ballots, saying the measure would likely curtail the ability of minorities to vote in the November 6 presidential election.

Evidence showed the law did the most harm to African Americans and Hispanics, who are more likely to live in poverty, Circuit Judge David Tatel wrote for a three-judge panel of the U.S. District Court in Washington.

Those without the underlying documents to obtain ID would have to purchase them, discouraging poor voters, he wrote. During the July trial, lawyers from the U.S. Department of Justice equated that purchase to an illegal poll tax.

Texas Attorney General Greg Abbott, a Republican, said he would appeal the decision directly to the U.S. Supreme Court.

"Today's decision is wrong on the law and improperly prevents Texas from implementing the same type of ballot integrity safeguards that are employed by Georgia and Indiana, and were upheld by the Supreme Court," he said.

Texas had the legal burden to prove its requirement did not harm minority voters. Judge Tatel's opinion called all the state's evidence "unpersuasive, invalid, or both."

The requirement was adopted in 2011 by the Republican-dominated Texas legislature. Voters would have had to present one of six forms of photo ID before casting their ballots.

1965 ACT AT STAKE

Supporters said the requirement would discourage fraud at the polls, but opponents called it a guise to suppress minority voters more likely to support Democratic candidates.

"Chalk up another victory for fraud," Texas Gov. Rick Perry, a Republican, said in a statement.

But Elise Boddie, director of litigation for the NAACP civil rights group, said: "The whole point of our democracy is to make sure that voters have the opportunity to vote, and that's what today's ruling does."

In March, the Obama administration blocked the requirement using the 1965 Voting Rights Act, a law designed to protect the voting rights of minorities, primarily blacks in Southern states.

Texas sued the U.S. government, arguing that it would be easy for a person without an ID to obtain one before the November 6 election. Texas lawyers said most voters already had IDs, and those who did not could get IDs for free if they had the underlying documents.

Since the 2010 election, in which Republicans gained control of many state and local governments, 11 U.S. states have passed voter ID laws, among other election rule changes.

The Obama administration has used the Voting Rights Act to counter the new wave of Republican measures that include voter ID requirements, redistricting maps and new ballot formats. Since the 2010 election, there have been more lawsuits under the Voting Rights Act than in the previous 45 years combined.

SUPREME COURT REVIEW

The challenges are building toward a possible U.S. Supreme Court review of the part of the Voting Rights Act that allows the federal government to block rule changes in certain states.

Two challenges reached the Supreme Court on July 20. If the court agrees to hear those cases during the term starting in October, it will weigh whether the key provision of the civil rights-era law is still necessary.

Any review of the Texas decision would focus only on the state's requirement itself and not the constitutionality of the Voting Rights Act.

Earlier this week, a different panel of the same Washington federal court blocked Texas' redistricting maps under the Voting Rights Act, saying they discriminated against blacks and Hispanics. Texas will likely use interim maps drawn up by a San Antonio federal court for the November elections.

Texas State Rep. Trey Martinez Fischer, head of the Mexican American Legislative Caucus, said the rulings on redistricting and voter ID were proof that the entire Voting Rights Act was still necessary.

"In the span of three days, we have had Texas' dirty laundry aired on a national stage. A history that we are not very proud of. A history that we have all claimed that we have overcome, and we have been told, in the year 2012, no longer exists," Fischer told Reuters.

The case is Texas v. Holder, U.S. District Court, District of Columbia, No. 12-cr-00128.

It is not crispy, precisely. It is never greasy. It is simply a pillow of ricotta built around a slice of ham, wrapped in a cloak of gold. It is the finest calzone in New York City. Sandwich: There are plenty good sandwich options at Defonte's, an old dockworkers' canteen near the mouth of the Battery Tunnel. But fried eggplant with fresh mozz and a scattering of hot peppers is the best, best consumed with a Manhattan Special coffee soda and two tabloid newspapers in 30 minutes or less, sitting in the front seat of an American-built vehicle.

Coffee: Stumptown roasts coffee in Red Hook, but no longer seems to sell it brewed in any sort of helpful way. You need to head all the way up to Iris Caf?, under the BQE, to find it made.

Bagel: There are no credible bagels available in South Brooklyn at this time. Head up the slope to Prospect Park instead, get a dozen at Terrace Bagels, and count yourself lucky.

Delivery food: There are no credible food deliveries available in South Brooklyn at this time. You hear that, Andy Ricker? Some Pok Pok wings to go, brought on a bike, real fast?

Chinese takeout: What has happened to Chinese takeout food in South Brooklyn and Brooklyn Heights in the past 30 years is nothing less than a tragedy, and there is nothing in the region to compare to the greats of the past, notably the late lamented Chun Yuan and China Chili, both on Montague Street. But Lichee Nut will do in a pinch?at least so long as you add to whatever order you make at least one plate of dry-saut?ed green beans or bok choy with garlic.

Late-night eats: One of the great things about South Brooklyn is that it folds like a tent around 11. You can haunt your way along Smith Street looking for late-night grub. But the dark side streets tell the story. This is sleepytown, USA. Hit the BQE and head up to Williamsburg, you want that late-night steak frites.

Rand Paul To Campaign for Romney While Dad Won't Endorse

Former GOP presidential candidate Rep. Ron Paul has declined to endorse Mitt Romney, but his son Sen. Rand Paul will soon hit the campaign trail to support the newly-minted Republican nominee.

"We are hoping to help Gov. Romney get elected," Rand Paul told ABC News' Jon Karl after wrapping up his speech at the GOP convention tonight.

The younger Paul said he is working out the logistics of appearing at campaign events for Romney between now and November.

"They've asked me to go places and I'm happy to," he said.

During a convention aimed at uniting Republicans and stoking enthusiasm leading into the last two months of the election, a rift seems still to exist within the party between a small but vocal group of ardent Ron Paul fans and the larger crowd of Romney supporters.

Shortly after Rand Paul wrapped up his speech, a boisterous group of about 100 Ron Paul supporters marched through the second floor of the convention hall shouting "So Maine goes, so goes the nation."

The protesters, most of which were wearing Ron Paul shirts and buttons, said they were upset the Republican National Committee stripped Ron Paul's Maine delegates of their convention seats.

Ron Paul was not given a speaking spot at the convention, as his fellow former GOP candidate Rick Santorum was, but Paul was the only Romney rival who was honored in a tribute video, which played directly before his son Rand took the stage. One of the largest applause lines during Rand Paul's speech came when he mentioned his dad.

Ron Paul did not watch the video from the forum or anywhere in Tampa for that matter. The campaign said last week that the congressman would stay for both his video, originally scheduled for Tuesday and for a speech by his son, but instead chose to skip out and head back to Texas.

The three-minute video featured clips of Paul, his wife Carol, son Rand and included several of his colleagues giving testimony to his "principles and his dedication to America."

"The longer we go and the deeper in debt we get, the more apparent it is that Ron Paul was right all those years," says Sen. Jim DeMint in the video adding that he thought Paul "was nuts" when they first met.

"Whether people want to admit it or not, Ron Paul changed the conversation," adds Senate Minority Leader Mitch McConnell.

Convention planners approved the video as an olive branch to the more than 300 Paul delegates that the congressman collected during his long primary battle with Mitt Romney.

"Congressman Paul's people came to us and said we'd like to do a short tribute to him, and we said absolutely," Mitt Romney campaign strategist Russ Schriefer told reporters last week.

Schriefer said that while Romney and Paul "certainly disagree on many issues," the one time rivals had "a lot of mutual respect" for each other.

The Romney campaign still has some appeasing to do. Earlier this week, Paul supporters stormed out of the convention because of the dispute over the Maine delegation. His supporters were also upset about new rules that would allow the party establishment to reject certain delegates and to make rule changes with a supermajority of votes. The concern: Republican party leaders are taking power from the grass roots.

Ron Paul told ABC News last week that it is a "possibility" that his son Rand would take his place as a leader of the supporters who have so diligently supported him through this year's presidential campaign, as well as his two previous White House bids.

"I'm sure he's the one who will finally make that decision on what he does and how far he goes, but I'm sure he's interested and very much involved in trying to promote these ideas," Ron Paul said.

While Rand Paul would not say whether a presidential run was in his future, the senator said after his speech on Wednesday that he does "see myself as part of the national debate."

"Being in the Senate is part of the national debate," he said. "If that's all I do then I'm really pleased to do it. But there may be more. We'll see."

Republicans and Democrats have made their political and ideological?stance on President Obama's health care law a key part of their respective campaigns. But recent data suggests that Americans are preoccupied with the more practical matter of how much it will cost them to get the care they need.

Experts say?the focus on pocketbook issues reflects both the nation?s preoccupation with household finances amid the difficult economy, and the fact that the Affordable Care Act is poorly understood.

?People don?t think about the nation?s health care costs,? said Mollyann Brodie, senior vice president for public opinion and survey research for the Kaiser Family Foundation. ?They?re not thinking about the total amount the nation is spending on health care. What they think about is the price they pay, the price coming out of their paycheck.?

Brodie noted that it?s been hard for either opponents or proponents of the Affordable Care Act to explain how the big health care reform program will affect people?s individual health care costs.

That's partly because the effect will be very different depending on what kind of health insurance, and health care needs, you have. And it's made more complicated because many provisions of the law aren?t set to take effect until 2014 or later.

Also, although people may have deep partisan feelings about whether such a plan is necessary, in their everyday lives they?re more concerned with how they can afford the health care they need.

?When you ask them what bothers me, what bothers me is I can?t afford the premium,? she said.

A Kaiser Family Foundation survey conducted this month finds that even among Republicans, health care costs are a bigger health-related concern than any issues they might have with "Obamacare."

The Kaiser survey of about 1,200 Americans found that 67 percent of Republicans said the cost of health care and health insurance was either extremely or very important when choosing a president, while 61 percent said Medicare was the top health care issue in choosing a president.

A smaller number of Republicans, 54 percent, said the 2010 health care law that has been such a hot topic of political debate was extremely or very important to their decision. Romney, the Republican presidential candidate, has vowed to undo many aspects of the law if elected.

Among Americans of all political affiliations, health care cost also ranked as the most second worrisome economic issue, right after jobs, in the Kaiser survey.

A separate Gallup survey also showed that health care costs remain a top worry among American workers as well. It found that American workers are more worried about getting their benefits cut than about having their job eliminated, despite an unemployment rate that is above 8 percent.

The Gallup poll of about 500 working adult Americans, which also was conducted in early August, found that 40 percent?were worried that their benefits will be cut, while 28 percent were worried about losing their job.

Paul Fronstin, director of the Employment Benefit Research Institute?s health research and education program, said it?s no surprise that Americans are so concerned about the cost and availability of benefits. Fronstin noted that health care costs have been rising for years. That?s left many?employees either being asked to contribute more toward the cost of their care, or finding that their employer simply doesn?t offer a plan they can afford.

?Benefits have been eroding. We have seen deductibles going up, and we have seen copayments going up,? he said.

The Gallup survey has for years shown that Americans are most worried about benefit cuts. But the concern spiked when the economy began to falter. Perhaps surprisingly, it has continued to outpace fears of a job loss even as millions of Americans have lost their jobs.

These days, Fronstin said many people may feel like they made it through the recession and therefore don?t have to be as worried that they will lose their job. Yet they still may worry that their employer will continue to ask them to pay more for health care, and they may wonder how they will swing that added cost.

?People are starting to get over that (fear that) they?re going to lose their job because the unemployment rate has been coming down, even slightly,? he said. ?But it doesn?t make them feel better about their benefits.?

Markets stall as traders await US Fed chief speech

PARIS (AP) ? Stock markets retreated Tuesday due to global worries about the impact of the eurozone debt crisis and as investors awaited a key speech by the U.S. central bank chief.

Investors are looking for confirmation that central banks in the U.S. and China will provide more economic stimulus and that the European Central Bank will intervene in bond markets to lower some countries' high borrowing costs.

Federal Reserve Chairman Ben Bernanke will hold an important speech later this week that investors will watch carefully for clues about the central bank's intentions to try to speed up the U.S. economic recovery.

Meanwhile, the ECB plan remains subject to debate ahead of the bank's monthly meeting on Sept. 6, when it is expected to announce more details. Germany's central bank is still opposed to the plan to buy government bonds.

Until the central banks clarify their positions, investors are likely to remain cautious, analysts say.

By midafternoon in Europe, stocks were extending earlier across-the-board losses. Britain's FTSE 100 lost 0.4 percent to 5,755. Germany's DAX fell 0.9 percent to 6,984. France's CAC-40 lost 1.1 percent to 3,425.

Wall Street's lower open appeared to accelerate Europe's decline, with the Dow Jones industrial average down four points to 13,122. The Standard and Poor's 500 index fell two points to 1,407.

Economic signals from Spain were mixed. It sold ?4 billion ($5 billion) in an auction of short-term debt at much lower interest rates, reflecting greater investor confidence.

But it also downgraded its economic growth over the past two years. Data released Tuesday showed the economy contracting 1.3 percent in the 12 months through the second quarter, more than the 1 percent previously calculated.

Meanwhile, the country's northeastern region of Catalonia became the third region to ask for financial help from the government in Madrid, underscoring the extent to which even the country's more powerful centers of industry and business are unable to manage their debts.

In neighboring Portugal, foreign inspectors arrived for meetings with local officials to assess the country's compliance with terms of its bailout agreement.

Bailout lenders may have to grant Portugal more time to meet its deficit goal ? something they are already hesitant to grant to Greece, which is also missing its debt reduction targets. The inspectors may therefore demand more austerity, which could drive the weak Portuguese economy deeper into trouble.

News that the head of the European Central Bank has called off his trip to an important conference of central bankers in the U.S. also drew attention. A spokesperson for ECB head Mario Draghi said he had cancelled his trip to the Jackson Hole, Wyoming conference this week "because of the heavy workload foreseen in the next few days."

In Germany, a survey of consumer confidence provided little relief. The GfK research institute said consumer confidence in Europe's largest economy was stable despite the ever-increasing worries that Germany will suffer from the debt crisis weighing on many other European countries.

Earlier in Asia, the Tokyo Stock Exchange's benchmark Nikkei lost 0.6 percent to close at 9,003.29. South Korea's Kospi index was down nearly 0.1 percent to 1,916.33, while the Hang Seng index inched up marginally to 19,811.80. Key indexes dipped in Singapore, Indonesia and Taiwan, while rising in New Zealand, mainland China and Australia.

Also weighing on sentiment was a monthly Japanese government report on the economy, released Tuesday, whose language on the main assessment was changed ? to a more pessimistic one, for the first time in 10 months ? to highlight concerns about weaknesses, stemming from dwindling exports.

Concerns about a slowdown in China, the major driver of growth in recent years, were behind the change, Japan's Cabinet Office said.

In other markets, the benchmark oil contract for October delivery rose 74 cents to $96.21 per barrel in electronic trading on the New York Mercantile Exchange. The contract fell 68 cents to end the day at $95.47 in New York on Monday.

In currencies, the euro rose to $1.2551, up from $1.2503 late Monday in New York. The dollar fell to 78.56 yen from 78.75 yen.

Yosemite officials say 1,700 visitors risk disease

FRESNO, Calif. (AP) ? The rustic tent cabins of Yosemite National Park ? a favorite among families looking to rough it in one of the nation's most majestic settings ? have become the scene of a public health crisis after two visitors died from a rodent-borne disease following overnight stays.

On Tuesday, park officials sent letters and emails to 1,700 visitors who stayed in some of the dwellings in June, July and August, warning them that they may have been exposed to the disease that also caused two other people to fall ill.

Those four people contracted hantavirus pulmonary syndrome after spending time in one of the 91 "Signature Tent Cabins" at Curry Village around the same time in June. The illness is spread by contact with rodent feces, urine and saliva, or by inhaling exposed airborne particles.

After the first death, the park sanitized the cabins and alerted the public through the media that the cause might have been diseased mice in the park.

However, officials did not know for sure the death was linked to Yosemite or the campsite until the Centers for Disease Control determined over the weekend that a second visitor, a resident of Pennsylvania, also had died.

After every park tragedy, officials stress that Yosemite is a wilderness area and with it come some dangers.

"We're very concerned about visitors and employees," park spokesman Scott Gediman said. "But we feel we are taking proactive steps in both cleaning the affected areas and in public education. But it's absolutely impossible to eliminate all risk."

On Sunday night, health officials with the National Park Service sent out an alert asking public health authorities to be on the watch for more potential rodent-related cases of acute respiratory failure.

Yosemite receives 4 million tourists a year from around the world, and national park officials were trying to determine if the warning should be expanded to include foreign countries.

"We're discussing whether to do that and how to do that," said Dr. David Wong, chief of the epidemiology branch of the National Park Service Office of Public Health.

The disease can incubate for up to six weeks before flu-like symptoms develop. It's fatal in 30 percent of all cases, and there is no specific treatment. It is not spread human-to-human.

Wong said the Yosemite cases are unusual because hantavirus illnesses are most often isolated events.

"We are seeing more than one person who got it in a narrow space and time," he said. "It makes us wonder why, and those are questions we don't have the answers to."

All the victims stayed in the cabins between June 10 and June 20, and all four known cases were contracted by people who stayed within 100 feet of each other but not necessarily in the same cabins.

The National Park Service currently has assigned two epidemiologists to work in the park trapping rodents for testing. Additional studies are being done to determine if the Yosemite rodent population is higher than normal after a record snowpack in 2011 provided ample water for the grass seeds mice favor.

"Rodents and mice are native to the park, but we are looking at the populations and working with our wildlife biologists to determine if the population is too high," Gediman said. "There are rodents here, and we could never trap them all so that's not going to mitigate it."

As the Labor Day weekend approaches, some people have cancelled reservations at Curry Village after hearing about the outbreak, Gediman said.

The camp sits at the base of the 3,000-foot Glacier Point.

After boulders rained down in 2008, the park permanently closed some cabins. The newer, insulated Signature Cabins were built in 2009 to replace them. Investigators are trying to determine why those cabins were involved in the outbreak.

Park concessionaire Delaware North Co., which oversees the cabins, did not immediately return phone calls seeking comment.

Rangers are handing out information brochures at the park entrance warning people to avoid mice in general and mouse droppings in particular.

People with reservations in the affected cabins are not being notified before arrival, but they are being warned during check-in to report any sightings of mouse feces.

"This is a serious public health issue and we want to be transparent, but at the same time we don't want people to alter their plans, because we are taking the necessary precautions," Gediman said.

Since the first illness was reported earlier this month, employees of Delaware North disinfected all 408 canvas-sided and wood-sided cabins in Curry Village. Workers are in the midst of shoring up the cabins in an attempt to keep mice from have easy access.

Epidemiologists say none of the victims had anything in common other than staying in Yosemite cabins.

A 37-year-old man from the San Francisco Bay area was the first person to die. Further details have not been released because of medical privacy laws.

Of the 587 documented U.S. cases since the virus was identified in 1993, about one-third proved fatal.

Deer mice were determined to be the main carriers of the virus, though other rodents can be infected, according to the Centers for Disease Control. Most of the cases occur in the West, though researchers are not sure why.

This year's deaths mark the first such fatalities of park visitors, although two others were stricken in a more remote area of the park in 2000 and 2010.

There have been at least two other fatal cases in national parks in the past few years, including a deputy superintendent at Glacier National Park who died in 2004, and a tourist at the Grand Canyon who was stricken in 2009.

Wong said health officials never were able to determine whether the victims contracted hantavirus inside the park grounds.

New clues in Taylor Swift video? MTV offers a look

LOS ANGELES (Reuters) - Fans of country singer Taylor Swift looking for new clues on the subject of her hit song, "We Are Never Getting Back Together," may want to watch the video premiering this week on MTV and sister TV network CMT, the television channel said on Tuesday.

The video, in which the 22-year-old gets personal about her dating life, will debut on "MTV First: Taylor Swift" on MTV Thursday at 7:49 p.m. EDT and on country music sister channel, CMT. MTV News will air a 30-second "sneak peek" on Tuesday.

Swift will also perform the song live on the MTV Video Music Awards on September 6, the network said.

The song, the first single from the country star's upcoming album "Red," has already become a hit. Last week, it broke the Billboard chart record as the most downloaded song by a female artist in its first week, selling 623,000 copies.

It also has spurred a guessing game among fans about which ex-boyfriend Swift is singing about in lyrics such as:

"I'm really gonna miss you picking fights/And me, falling for it screaming that I'm right/And you, would hide away and find your peace of mind/With some indie record that's much cooler than mine."

Aspirin and Cancer: May Help With Prostate, Not With Breast ? AARP

A pair of new studies, published Monday in the Journal of Clinical Oncology, offers contrasting news about aspirin?s potential role in cancer prevention and treatment.

Men who were being treated for prostate cancer and were taking aspirin for other medical conditions were less likely to die of their cancer than men who were not taking aspirin, the New York Times reports.

On the other hand, taking aspirin did not appear to protect postmenopausal women from developing breast cancer, according to Health Day news.

Previous research, some of it by the Harvard researchers involved in this breast cancer study, has shown that aspirin may help lower the risk of developing colon cancer.

There were big differences between the two new studies, explained Stanley Liauw, M.D., author of the prostate cancer study and an associate professor in the department of radiation and cellular oncology at the University of Chicago Medical Center.

The breast cancer study looked at how aspirin might prevent a new cancer from occurring, while the prostate study looked at how aspirin might keep an established cancer from getting worse.

Liauw also told Health Day that the different sites in the body where the two cancers occur may play a role in why aspirin had a dramatic effect in one, but not the other.

In the prostate study, 6,000 men who had undergone either surgery or radiation therapy were followed for 10 years. About 37 percent of the men were already taking some type of anticoagulant, such as aspirin, warfarin or Plavix, when the study began.

Liauw and his team found that those who were taking aspirin had a 57 percent reduction in the risk of death from prostate cancer. Prostate cancer is the most common cancer occurring in men.

Keep in mind, however, that this was not a randomized, controlled trial ? considered the gold standard in clinical research. No dosage information was collected, so researchers cannot say exactly how much aspirin was most beneficial.

But researchers found that the prostate cancer death rate for those taking aspirin was 3 percent, compared with 8 percent for those who did not, the New York Times reported. Also, the aspirin users were significantly less likely to experience a recurrence of prostate cancer or have the disease spread to the bones, the study found.

In the breast cancer study, researchers led by Xuehong Zhang, M.D., an instructor in medicine at Brigham and Women?s Hospital in Boston, tracked nearly 85,000 postmenopausal women, all of whom were working as registered nurses when the study began.

Nearly every two years, the women completed questionnaires on their medical histories and lifestyle, including their routine use of aspirin or other non-steroidal anti-inflammatories (NSAIDs), like acetaminophen.

Over 30 years, more than 4,700 of the women developed some form of invasive breast cancer. Yet, Zhang?s team wrote that? use of aspirin or other NSAIDs did not have any significant impact on lowering either overall breast cancer risk or the risk for a specific subtype, like receptor 2 positive.

Health experts, however, caution that older adults should not begin taking aspirin without first consulting their doctor.

While many Americans use low-dose aspirin to reduce their risk of heart disease, taking aspirin regularly increases the risk for gastrointestinal bleeding and stroke.

(AP) ? The few hundred protesters gathered under wet skies in a park about a half-mile from the GOP convention on Sunday said an impending hurricane that is supposed to dump even heavier rains on Tampa won't stop them from trying to get out their message that America's middle class is in trouble and needs to be restored.

Giant blocks of ice spelling out the words "middle class" were melting on a warm, sticky, rainy day. Occupy protesters it represents the melting away of the middle class.

That message rings true for 52-year-old Tom Gaurapp and Cheryl Landecker from Freeport, Ill. Both worked for Sensata Technologies, owned by Bain Capital, in the city of some 25,000 people. They say 170 jobs there, including their own, were outsourced to China. Occupy protesters are often made up of younger people who generally believe the financial system is stacked against the majority. But in Tampa, many older people joined the marchers.

They included Gaurapp and Landecker, who said that just a few years ago, they never would have considered joining such a protest.

"But then again, we wouldn't have dreamed our jobs would have gone to China," Gaurapp said.

For months, protesters were gearing up for scores of people to converge on Tampa the day before the convention began to showcase their laundry list of beefs and key messages. The groups included organized labor and Occupy Wall Street.

Neither protesters nor the GOP, however, could foresee Tropical Storm Isaac, which is expected to become a dangerous Category 2 hurricane by the time it makes land over the northern Gulf Coast sometime late Tuesday or early Wednesday. Tampa is expected to feel the brunt of the storm with winds, rain and maybe some flooding on Monday. The forecast caused Republicans to postpone their convention activities on Monday's opening day and not that many delegates seemed to be around Sunday to see the protesters.

The protests stayed small by mid-afternoon. And not all had the same message.

Some came to oppose just Mitt Romney, who officially will become the Republican nominee for president on Thursday. Others didn't seem to care for Romney nor President Barack Obama. And though jobs and wealth were strong messages, others had different agendas.

About 30 people, many with dogs, held a rally against Romney, who infamously strapped his dog in a crate to the top of his car on a family vacation years ago.

"If somebody is going to treat their animal inhumanely, how are they going to treat our country?" said Kim Swygert, 37, a law student from Tampa, who came with her Great Dane.

"He strapped his dog to the top of the car because he crapped, excuse my French," she said.

Several carried anti-Romney signs including one that read, "Don't roof rack me, bro."

The weather didn't deter 52 year-old Donald Butner. He says he's been sleeping at the Occupy camp in Tampa for a few months and that "we're here, baby, rain or shine. The weather is going to do what it is going to do."

Many protesters chanted "we are the 99 percent" and carried homemade signs. The 99 percent refers to the group's message that most don't share in the wealth of America.

The 54-year-old Landecker spoke to the group as rain started falling.

"These businesses have put corporate greed over everything else. If they can do it to us, they can do it to anybody," Landecker said.

Though protesters vow to stay put, if the weather threatens their safety or that of visitors on the streets, police officers will use public address systems and go person-to-person to warn them to leave, said Tampa Police Chief Jane Castor.

"As it is right now, there will be high winds and there will be rain but it's not going to be something that is going to prohibit anyone from doing what they want to do out on the streets," Castor said. "If it changes ... and it becomes an issue of public safety, we will order people into shelters."

About 50 people, from Occupy Wall Street and Code Pink groups, marched from the park about two blocks to the Tampa theater where the Faith and Freedom Coalition was holding an event. The protesters waved signs in front of people waiting to get into the theater, and seven of them lay down in front of the entrance. Other protesters covered them in a red cloth.

They were on the ground for about five minutes. When police asked them to move, they did, and then marched back to the park.

Code Pink is a women-focused group pushing to end the U.S.-led wars abroad. They held signs including, "Vagina. If you can't say it, don't legislate it," and "GOP, respect women."

"I'm completely opposed to the Ralph Reed agenda of the war on women," said Rae Abileah, 29, of San Francisco. Reed started the Faith and Freedom Coalition, which among other causes is against abortion.

Lilly heart drug Effient fails to carve new niche

MUNICH (Reuters) - Eli Lilly's new heart drug Effient failed to beat the older product Plavix in a head-to-head clinical study, dashing hopes for its expanded use in treating less critically sick heart patients.

The finding, released at a medical meeting on Sunday, is good news for rival AstraZeneca, whose competitor product Brilinta did show an edge over Plavix in a comparable group of patients in an analysis published last year.

The battle among the different blood-thinning drugs, which are all designed to prevent dangerous clots in heart patients, has moved up a gear this year with the expiry of patents on Sanofi and Bristol-Myers Squibb's Plavix.

That has opened the door to cut-price generic versions of Plavix, or clopidogrel, on both sides of the Atlantic, upping the ante on the newer rivals to prove they really offer a distinctive edge.

Lilly and its partner Daiichi Sankyo had hoped to prove that Effient was a better option for patients with acute coronary syndrome (ACS) who do not get a stent to open blocked arteries or bypass surgery.

ACS covers a range of serious conditions, including heart attacks and unstable angina, caused by a sudden reduction of blood flow to part of the heart.

In fact, the large study funded by the two companies and involving more than 9,000 patients found there was no difference between Effient and Plavix in preventing heart attacks, strokes and deaths. Both drugs were tested alongside aspirin.

There was also no difference in serious bleeding complications, which is always a risk with blood-thinners.

There was a lower risk of adverse events in patients on Effient after 12 months of treatment, but this trend was not conclusive and lead investigator Dr Magnus Ohman of Duke University Medical Center said further exploration of the finding was needed.

SURPRISING RESULT

Most trials evaluating anti-clotting drugs for ACS have focused on patients undergoing invasive procedures, usually getting a stent - a tiny wire mesh tube that is left in the coronary artery to prevent it from closing up again.

But some 40 percent of patients who are not in urgent need of such invasive intervention are managed solely with drug therapy, and it had been thought that they should do better on a newer and more potent medicine like Effient.

Daiichi research head Glenn Gormley said the trial result was "not the outcome we anticipated" and medical experts at the European Society of Cardiology annual congress, where the findings were reported, agreed the result was unexpected.

"The outcome is a bit surprising because we think usually that more aggressive therapy in the face of acute coronary syndrome would lead to less adverse outcome - but the data is what the data is," said Dr William Zoghbi, president of the American College of Cardiology.

Effient was launched three years ago and the drug has taken off more slowly than many analysts expected, with worldwide sales last year of $302.5 million. Analysts, on average, expect sales to reach $1.1 billion by 2016, according to Thomson Reuters Pharma.

The results of the Effient study were published simultaneously online by the New England Journal of Medicine.
